Eagle Pass Mayor Ramsey E. Cantu and Democratic Candidate for the position of Texas House District 74 State Representative seat has been administratively disqualified from being able to run in the March 2020 election by the State of Texas Democratic Party.
The Democratic State Party specifically party chair Gilbert Hinojosa has deemed that due to several provisions of the Texas Constitution including the Texas Election Code § 145.003, Texas Constitution Article. 3, § 19, and Texas Constitution Article.16, $ 17. Mayor Cantu is ineligible to run for the State Representative position.
The Information provided states that under the legal guide of the constitution, specifically Art. 3. § 19 No judge of any court, Secretary of State, Attorney General, clerk of any court of record, or any person holding a lucrative office under the United States, or this State, or any foreign government shall during the term for which he is elected or appointed, be eligible to the Legislature.
The Democratic Party further explains that due to standing laws and rulings on such similar matters including Texas Supreme Court case Willis v. Potts, 377 S.w.2d 622 (1964), and Texas Supreme Court in Wentworth v Meyer, 839 S.W.2d deem Cantu ineligible.
There are certain legal remedies that Mayor Cantu can attempt to pursue in this ineligibility ruling.
