The Texas Third Court of Appeals in Austin, Texas is scheduled to hear oral arguments regarding an appeal by Dos Republicas Coal Partnership and the Texas Commission on Environmental Quality’s (TCEQ) regarding the denial of a water discharge permit renewal by the coal mining company.
Oral arguments over the issue will be taking place on Wednesday, February 27, 2019, in Austin Texas before a three-judge panel.
The denial stems from an application to renewal by Dos Republicas which was denied by Travis County 250th Judicial District Judge Tim Sulak on October 27, 2017.
DCRP and TCEQ filed an appeal on the ruling and are now scheduled to go before the panel and present their arguments as to why the permit renewal should be granted.
During the parties presentations before the Third Court of Appeals, other issues affirmed by Judge Sulak will also be contested.
Dos Republicas Coal Partnership has been operating an open surface coal mine in Maverick County for several years and is looking to expand its operations for at least another five years.
Opponents of the mine are against the expansion and operation.
