City Council approves final reading to “Flea Market” Ordinance

The Eagle Pass City Council approved the final reading of an Ordinance amending Section 19-119, Article VII, Chapter 19 (Offenses and Miscellaneous Provisions) of the Code of Ordinances for the City of Eagle Pass, Texas; and amending Section 10 of Appendix A of the Code of Ordinances of the City of Eagle Pass, Texas, to prohibit the establishment of any new flea market operations except by Conditional Use Permit in an Industrial District and to allow existing flea markets to operate as nonconforming uses at their meeting held on Tuesday January 16.

During the meeting, the City Council discussed the issue in executive session and once reconvened back in public proceeded to approve the final reading setting the ordinance into motion and enforcement.

The ordinance includes clauses that will allow for a conditional use permit in an industrial area and an increase to the flea market operator fee going from $125 to $500 per year. The provisions will also limit the cease to operate period from 1 year to 90 days.

The ordinance also has an amendment which basically will not allow for any other flea markets to open up in the downtown business district area and will grandfather those existing in. The ordinance however does state that if any of those locals closes down for more than a certain amount of time consecutively it cannot open up anymore.
