Del Rio Federal Court Judge Alia Moses sentenced 21-year-old Elias De Jesus Gregorio De Paz a Guatemalan undocumented to 5 years in prison for assaulting a Border Patrol agent in 2016, announced John Bash, Prosecuting Attorney for the Western District.
In addition to the prison sentence, Judge Moses ordered that Gregorio de Paz pay $5,767 dollars to his victim for medical expenses and lost wages.
According to the report, on March 9, 2017, De Paz plead guilty to one count of assault against a federal official. Under oath he admitted that on November 19, 2016, he attacked a Border Patrol agent while he was engaged in the performance of his duties.
According to court records, US Border Patrol agents working in the Uvalde area encountered two undocumented foreigners. One of them ran away. The other, Gregorio de Paz, got involved in an altercation with the agent, hurting him. He then fled but was captured three days later by Border Patrol agents in the Del Río area.
De Paz has been in federal custody since his arrest.
“This case demonstrates the great sacrifice that Border Patrol Agents make every day, often risking their lives to protect our nation, and violence against Border Patrol agents will not be tolerated,” said FBI Special Agent. Christopher Combs
Official reports show that assaults against Border Patrol agents in the last year have increased. According to statistics during 2012 there were 555 assaults. They decreased to 373 in 2014. But the number of assaults went back up to 584 in 2016 and are at 847 in 2017.
